OVERVIEW

SECTION 1 - ACCESS AND ELIGIBILITY 

By agreeing to these Terms, you represent that you are at least 18 years of age, or that you have the consent of a parent or legal guardian. You are solely responsible for maintaining the security of your account credentials and for all activity on your account.

To use the Services you may be asked to provide information such as your name, email address, billing, payment and shipping details. You represent and warrant that all information you provide is correct, current and complete, and that you have all rights necessary to provide it.

SECTION 2 - OUR PRODUCTS

SelectPro Appliances sells appliances across up to three condition categories, sourced directly from manufacturers:

• Carton Damage - brand new, current-model appliances with damaged outer packaging only
• Finished Goods - brand new, superseded model appliances in new boxes
• Factory Seconds - fully functional, refurbished or ex-display appliances

By purchasing from us, you acknowledge and accept that:

• your order may be supplied as Carton Damage, Finished Goods, or Factory Seconds, as stated in the product listing, with the specific condition confirmed on your Delivery Docket at the time of pickup or delivery;
• items supplied as Factory Seconds may have cosmetic imperfections, indicated by a manufacturer condition sticker where applicable;
• products are in full working order unless stated otherwise;
• product images are illustrative and may vary slightly from the actual item;
• warranty terms vary by manufacturer and product, and are stated in each listing, and covers repair or replacement of parts and labour for functional defects only, not cosmetic damage; and
• products must be installed by a licensed professional where required (e.g. electrician, plumber or gasfitter) - installation by an unqualified person may void the manufacturer warranty.

We aim to represent our products accurately but do not warrant that descriptions, images or other content are error-free, and descriptions may change without notice. We reserve the right to limit quantities, discontinue products or decline orders at our discretion.

SECTION 3 - ORDERS AND CUSTOMERS

We welcome consumer and commercial customers, including tradespeople, builders, developers and businesses of all sizes, purchasing for personal, household or commercial use.

Placing an order is an offer to purchase; it is not accepted until we confirm acceptance and process payment. We may accept, decline or cancel any order at our discretion - if declined or cancelled, we will notify you and issue a full refund.

SECTION 4 - PRICES AND BILLING

Prices are in AUD and include GST unless stated otherwise, and are subject to change. The price charged is the price at the time your order is placed, as shown in your order confirmation.

A flat delivery fee applies to Melbourne metro orders and is collected at checkout; see our Delivery Policy for other locations. You agree to provide accurate payment information and to pay all charges incurred, including delivery fees and taxes.

SECTION 5 - DELIVERY

We deliver within Australia only, across Melbourne metro, regional Victoria and interstate. Melbourne metro delivery is a flat $99 fee collected at checkout. For regional Victoria or interstate orders, please contact us before purchasing so we can confirm availability and provide a freight quote; we will arrange delivery timing before dispatch.

Delivery timeframes are estimates only and not guaranteed. We are not liable for delays outside our reasonable control, including traffic, access issues, weather or carrier delays.

Risk passes to you on delivery to your nominated address. We recommend inspecting your order on delivery and noting any damage before signing your Delivery Docket.

SECTION 6 - INTELLECTUAL PROPERTY

All content on our Services, text, images, graphics and product information, is owned by or licensed to SelectPro Appliances and protected under applicable intellectual property laws. You may not reproduce, distribute, modify or commercially use this content without our written consent. All rights not expressly granted are reserved.

SECTION 7 - THIRD-PARTY LINKS AND TOOLS

Our Services may link to third-party sites or tools. We are not responsible for their content, accuracy or practices, and access is at your own risk. Any third-party tools we provide are offered "as is", without warranty.

SECTION 8 - PRIVACY

Personal information collected through our Services is handled in accordance with our Privacy Policy, the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

SECTION 9 - CONSUMER GUARANTEES

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL), including your right to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss. Nothing in these Terms excludes, restricts or modifies your rights under the ACL or other applicable law.

Manufacturer warranty terms vary by product and are set out in each product listing and our Refund & Returns Policy.

SECTION 10 - DISCLAIMER OF WARRANTIES

To the maximum extent permitted by law, and subject to your rights under the ACL, our Services and products are provided "as is" and "as available", with no warranties beyond those required by law.

SECTION 11 - LIMITATION OF LIABILITY

To the fullest extent permitted by law, SelectPro Appliances and its directors, employees and agents are not liable for indirect, incidental, special or consequential loss arising from your use of our Services or products, except where such liability cannot be excluded under the ACL or other applicable law.

SECTION 12 - FEEDBACK AND REVIEWS

By submitting feedback or reviews, you grant us a non-exclusive, royalty-free licence to use, publish and display that content to operate and promote our Services. You warrant that you own the content and that it is accurate.

SECTION 13 - PROHIBITED USES

You may use our Services for lawful purposes only. You must not use them for unlawful, fraudulent or harmful activity, to infringe others' intellectual property, or to send unsolicited commercial communications. We may suspend or terminate access for any breach of these Terms.

SECTION 14 - ERRORS AND OMISSIONS

We may correct errors, inaccuracies or omissions in our Services, including descriptions, pricing and availability, at any time without notice.

SECTION 15 - CHANGES TO TERMS

We may update these Terms at any time; changes take effect from the date posted. Continued use of our Services after changes constitutes acceptance. We will notify you of material changes as required by law.

SECTION 16 - TERMINATION

We may terminate or suspend your access at any time, without notice, for breach of these Terms or unlawful conduct. Provisions that should survive termination will continue to apply.

SECTION 17 - GOVERNING LAW

These Terms are governed by the laws of Victoria, Australia. You consent to the exclusive jurisdiction of the courts of Victoria for any disputes arising under these Terms.

SECTION 18 - SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

SECTION 19 - ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Refund & Returns Policy and Delivery Policy, constitute the entire agreement between you and SelectPro Appliances regarding your use of our Services.
